Comprehensive guide on the functions and practice of Commissioners for Oaths

Significant public misconception exists regarding the powers and functions of Commissioners for Oaths (“CFOs”). Likewise, there is a variance of views even within the fraternity over the precise ambits and scope of the powers and jurisdiction of CFOs, which has led to a degree of confusion. Although the act of affixing a seal may appear simple, every seal carries the exercise of judgment. It requires careful appreciation of the surrounding circumstances – the purpose of the transaction and the legal framework within which an oath, affirmation, or other formalised act is administered by a CFO.

This pioneering work serves as a comprehensive guide to the law, practice, duties and responsibilities of CFOs in Malaysia. Covering appointment, powers, professional conduct, regulatory compliance, document administration, financial management and contemporary challenges, the book provides practical and authoritative guidance for both aspiring and experienced CFOs. With comparative discussions on related legal office holders and selected international jurisdictions, it is an invaluable resource for CFOs, legal practitioners, the judiciary and legal academics alike.

This book serves as a dependable companion for prospective and newly appointed CFOs, and as a steady and solid reference for experienced practitioners. It definitively identifies the applicable legislation and corresponding forms, addresses the technical aspects of administering oaths or affirmations and execution of documents, and clearly delineates the proper ambit of the powers conferred upon CFOs to do so.

Key features:

  • CFO Powers & Jurisdiction Historical review of the powers and jurisdiction of CFOs, together with their contemporary application.
  • Relevant Legislation Near-exhaustive compilation of all legislation applicable and relevant to the work of CFOs.
  • Forms & Administration Clear summary of the prescribed forms and the nature of administration required for each form or set of circumstances.
