What Experts Say
“Amongst the most complex pieces of legislation after the National Land Code [Revised 2020] are the Strata Titles Act 1985 [Act 318] and the Strata Management Act 2013 [Act 757]. Act 318 was subsequently amended by the Strata Titles (Amendment) Act 2013 [Act A1450]. Together with the related Regulations and the National Land Code, these statutes form a comprehensive legal framework governing strata living in Malaysia.
Datin Harwinder Kaur d/o Harbhajan Singh, the first Sikh lady in Malaysia to be appointed President of the Strata Management Tribunal (SMT), together with her co-authors RK Nandy, Ivanpal Singh and Jesrina Kaur, brings together a remarkable blend of judicial, practical and academic experience. During her tenure at the SMT, she presided over numerous disputes involving proprietors, purchasers, developers, joint management bodies and management corporations, giving her invaluable insight into the practical application of Malaysia’s strata laws.
Her experiences have inspired this comprehensive work, guiding readers through the legal framework governing strata management, the establishment and responsibilities of statutory bodies, and the rights and obligations of developers and proprietors. Across 18 chapters, the authors have combined practical procedures, judicial precedents, legal analysis and practical guidance to address the issues most frequently encountered in strata management.
I am humbled to pen this foreword for Harwinder, Nandy, Ivanpal and Jesrina. I congratulate them on this remarkable achievement, executed with professionalism and clarity. The judiciary, legal practitioners, regulators, students and teachers of law will warmly welcome this masterpiece.”
— The Honourable Dato’ Mary Lim Thiam Suan
Retired Judge of the Federal Court of Malaysia
